[Implementation
of the plan in true letter and spirit is the only way forward to eliminate
extremism and terrorism in all its forms and manifestations and establish peace
to create climate conducive to INVESTMENT, which will help ensure
socio-economic justice in the society. The federal government has taken certain
measures; but a lot has yet to be done. The Attorney General\'s office filed
reply to the Supreme Court on behalf of the federation in regard to the
petitions filed by Lahore High Court Bar Association and others against 21st
amendment. While advocate generals of Sindh, Punjab
and Balochistan submitted replies on behalf of their respective provincial
governments on Monday, the Khyber Pakhtunkhwa had submitted its reply already.
All the provincial governments supported the amendment and endorsed the points
highlighted by the federal government in its reply to the Supreme Court.
It
has been stated in the reply that the 21st Amendment did not usurp the
judiciary\'s power or put any restrictions, and that the Objective Resolution
was not above the law and constitution. It requested the apex court to dismiss
the challenges because they had no merit and for the sake of all those who had
sacrificed their lives in the war against terrorism, for the sake of children
(who died in the Peshawar
school attack) and for the sake of the future of the country. The people have
spoken through their elected representatives. The federal government and all
the four provinces have supported the establishment of military courts for the
trial of terrorists in the country. To fight terrorism is indeed a Herculean
task, and the nation as a whole will have to participate fully, and the
objectives can be achieved by showing firm resolve, patience and hope.
The
21st amendment to the Constitution provided constitutional cover to trial of
offences relating to terrorism by military courts, whereas Pakistan Army Act,
1952 was also amended. The Constitution (21st Amendment) Act, 2015 shall remain
in force for two years from the date of its commencement, and shall cease to be
part of the Constitution and shall stand repealed on the expiration of the
period. After 5-hour meeting of parliamentary leaders chaired by Prime Minister
Nawaz Sharif, all leaders reached consensus on all points of National Action
Plan including establishment of military courts. Persistent efforts are needed
to expose the parties, individuals and madaris having direct or indirect
linkage with terrorism, sectarianism and their foreign masters, and take
measures to stop their funding. Sri
Lanka could decimate Tamil Tigers only when
it succeeded in stopping the funding and supply of arms to them.
In
All Parties\' Conference, political parties were in complete unison on 20
points National Action Plan (NAP); but now certain political parties disown it
on various pretexts and are taking a different stance due to their vested
interests. It is strange that after political leaders of the parties had given
their consent in the conference of parliamentary leaders convened by the Prime
Minister Nawaz Sharif, why a few of them stayed away from voting and did not
raise dissenting voices? Political division on the issue will certainly take us
away from desired goal of eliminating extremism and terrorism from the society,
which has immensely harmed the country. Pakistani leadership and the government
should demonstrate the resolve, ignore detractors of NAP, show zero tolerance
towards anti-state elements and move forward to attain the objectives outlined
in the NAP.
Politicians
should feel the pulse of the masses and synchronize their aims and objectives
in line with the ground realities and reform their political agenda by showing
what a change really means and how. Provincial civil administrations have to
gird up their loins to fight terrorists in its domain; it should start search
operations and identify terrorists as well as those elements that aid and abet
them in terror acts. Of course, it would require revamping of CID, special
police and other intelligence networks under the civil administration because
it is their responsibility to take care of the streets and bazaars of the city.
Had civil administrations taken steps, many terrorist attacks could have been
averted. Military courts have started functioning; but other points in the NAP
are not less important, and should be implemented in letter and spirit.
